General Terms and Conditions for Ski and Snowboard Building Seminars of SPURart
These General Terms and Conditions apply to all seminars and events organized by SPURart.

General Terms and Conditions

1. Registration, Conclusion of Contract and Due Date of Payment

1.1 After registering for a ski-building seminar organized by SPURart, you must transfer the agreed course fee to the specified account within 10 days. The contract shall be deemed concluded and binding for both parties only upon receipt of the aforementioned payment in the SPURart bank account. No further confirmation will be sent to the participant.
1.2 Upon receipt of the course fee, the participant will receive several theoretical course materials, a design guide, a mold guide, and a questionnaire. The questionnaire must be returned independently to SPURart. Questionnaires that are not received at least 6 working days before the start of the course will no longer be processed. In such cases, the participant will simultaneously forfeit the right to the creation of a personal, individual ski.
1.3 In the event of late payment, the organizer is entitled to remove the participant from the list of participants.

2. Withdrawal / Cancellation by the Participant

2.1 Each participant has the right to withdraw from the seminar at any time. Cancellation must be made in writing (date of receipt is decisive). In the event of cancellation, the following seminar fees shall be payable:

Up to two months before the start of the seminar: free of charge
60 days – 15 days before the start of the seminar: 50% of the seminar fee
14 days – 1 day before the start of the seminar: 90% of the seminar fee
On the day of the event or in case of non-attendance: 100% of the seminar fee

3. Withdrawal by the Organizer

3.1 The organizer reserves the right to cancel the seminar up to 15 days before its start without stating reasons.
3.2 Furthermore, the organizer is entitled to cancel the seminar if, due to unforeseeable force majeure, such as political unrest, environmental disasters, or health-related reasons, the execution of the seminar becomes impossible or significantly impeded. In this case, the claim to payment of the full seminar price shall cease. However, the organizer may claim reasonable compensation for services already rendered or still to be rendered.

4. Changes to the Seminar and the Seminar Price

4.1 If the seminar cannot be conducted, or can only be conducted in part or with changes, for reasons beyond the organizer’s control (weather conditions, force majeure, insufficient skills of participants), participants shall have no claims, unless expressly agreed otherwise in writing.

5. Risk Notice and Limitation of Liability

5.1 Each participant must be aware when booking the seminar that activities in the craft and workshop environment involve risks. Despite the highest level of safety precautions, every activity in the workshop involves a residual risk that the organizer cannot influence. Serious injuries or fatalities cannot be entirely excluded, even with the utmost care.
5.2 The liability of SPURart for damages caused by slight negligence that do not involve bodily injury is limited to three times the seminar price. The same applies to damages caused by the fault of a service provider.
5.3 For liability reasons, ski bindings are mounted; however, SPURart cannot perform regulation-compliant adjustments of the ski bindings and refers participants to professional adjustment by a specialized sports retailer.

6. Insurance

6.1 Each participant must have valid personal liability insurance.

7. Materials and Personal Skills

7.1 The organizer provides the participant with special workshop materials during the seminar. These materials are entrusted to the participant until they are returned to the organizer. In the event of loss or damage to the workshop materials, the organizer reserves the right to pass on the incurred costs to the participant responsible.
7.2 The events conducted by SPURart require a high degree of craftsmanship, concentration, and personal responsibility on the part of the participant. The organizer is entitled to exclude participants from the ski-building seminar or from further participation if they unnecessarily delay the group, fail to follow the instructions of the seminar leaders, demonstrate serious deficiencies in craftsmanship, damage tools or facilities, or endanger other persons. In the event of exclusion, all claims for reimbursement of any fees shall lapse.

8. Claims

8.1 The purpose of the “ski-building seminar” is to teach basic techniques for the later independent production of ski sports equipment.
8.2 The purpose of the event is not the manufacture of a winter sports device.
8.3 The organizer does not guarantee the error-free manufacture of a ski sports device in terms of appearance, function, or both.
8.4 The participant has no warranty claims whatsoever regarding the functionality or service life of the ski sports equipment produced during the seminar.

9. Limitation Period

9.1 Any warranty claims must be asserted by the participant against the organizer within one month after the contractually agreed end of the seminar. Claims pursuant to the above sentence shall become time-barred one year after the contractually agreed end of the event.

10. Place of Jurisdiction and Applicable Law

10.1 The place of jurisdiction shall be the registered office of SPURart. In business transactions with merchants, legal entities under public law, or special funds under public law, the place of jurisdiction for legal action shall be Innsbruck. If the client’s domicile or habitual residence is unknown at the time legal action is brought, or if the client relocates their domicile or habitual residence outside the scope of the law after conclusion of the contract, Innsbruck shall be agreed as the place of jurisdiction. Austrian law shall apply exclusively.

11. Severability Clause

11.1 Should individual provisions of these General Terms and Conditions be or become invalid or void contrary to the current intentions of the parties, this shall not affect the validity of the remaining provisions of these General Terms and Conditions or of the contract.
